Courts Rule That P2P Services Can Be Sued

 RulingThe US Supreme Court ruled today that File Sharing companies can be brought to court and sued IF there is evidence that the company was promoting the service as a way to illegally share content (music, movies, etc.). 
This is a win for the RIAA and MPAA - one that, even though I don't really agree with those organizations on much of what they do, I am glad to see. The reason I am happy with the ruling is because of the basis of the ruling - the offending company would have to have PROMOTED the illegal use of the application. If knife makers went out and said "this Kilr-Ever-Sharp is the knife you want when you need just need to bring a dude down" then I would say - Sue the bastards. HOWEVER, knife companies don't do that and yet people use their "apps" illegally. It is a fine line, I know, but an important one.

Should Grokster be held responsible? Maybe, if they are actively promoting illegal file trafficking (I don't think the overtly do). But, should the RIAA have Carte’ blanche right to close any distribution site that could be used for legal reason? Or should they be allowed to dictate to technology companies on what type of filtering or DRM they need to use? Hell No!!

But, then again, what do I know? I just see these services and sites as ways of spreading and distributing fantastic non-commercial music and the great equalizer for the little guy.
